Terms and Conditions
1. Definitions
‘Us’, ‘We’, ‘Our’ and other third person terms refer to Review4Students.Com, however in some instances, these terms may apply to both Review4Students.Com and the customer.
‘You’- refers to our customers (i.e. all those who use our service)
‘Work’- refers to any essays, projects, dissertations, coursework, consultation paper and any other document that you send to us to be reviewed.
‘Subscription Package’- refers to any of the subscriptions that we offer that are payable on a monthly basis.
2. General
The current Terms and Conditions are prepared in order to detail the manner in which we will conduct our business with you. You are at the heart of everything that we do therefore we have devise our terms and conditions in a manner that will facilitate a good working relation between us. We reserve the rights to vary the terms of this agreement at anytime; therefore we recommend that you should check our website on a regular basis where you can view any changes that we have made to the agreement. The usage of our services is subject to full acceptance of our terms and conditions. Once you have decided to register with us, send work to us or order any of the services that we provide this will be deemed as acceptance of our terms and conditions. Consequently, it is imperative that you read these terms and conditions carefully.
3. Using Our Service
3.1. We offer both a pay-as-you-use/one off payment option (indicated by the ‘Buy Now’ link on our website) and a subscription package.
3.2. In order to benefit from our subscription package you must register with us. This can be done by completing our online registration form.
3.3. Once you have registered with us you will be able to select a username, (which will be the email address that you use when registering) and we will allocate you with a user-number.
3.4. We offer three main subscription packages, basic, silver and gold. All subscription packages are available on a 3 months minimum term contract.
3.5. You must ensure that there is sufficient funds available in your account or on your credit/debit card to clear all outstanding balance owing to us
3.6. Our one off payment option will enable you to purchase an order without having to subscribe with us.
3.7. Where you select our one off payment you will be required to complete an order form. It is your duty to ensure that you complete this form accurately stating any additional information that you would like us to consider when reviewing your work
3.8. You will also be able to gain a free-quote from us. This can be done by selecting the appropriate link on our website.
3.9. The quotes we offer generally apply to: essay writing, reviewing your work on a one-off payment basis, tuition services and any other service that we may offer on a non-subscription basis.
4. Sending Work to Us
4.1. You must ensure that you send us all works that you want us to review within a minimum period of 48 hours from the date that you want us to complete this work.
4.2. We will send you confirmation acknowledging that we have received your work within 24 hours.
4.3. Work sent to us outside this timescale, especially work sent to us at last minute may not be completed on time.
4.4. Where the above occurs we will not accept any liability for the consequence of such work being submitted late and cannot guarantee that we will be able to send your work to you within your required timescale.
4.5. Work may be sent to us electronically via our website. If you would like to send your work to us by any other means, please contact us in advance to discuss this.
4.6. By sending work to us, you agree that we can edit your work in order to improve its standard. In doing this, we may make changes to the grammar, structure, sentences, paragraphs, headings, spelling and other changes as we see fit.
4.7. The editing that we undertake to your work will not include changes to your assessment criteria.
4.8. Where you have any special request about your work, it is your obligation to ensure that this request is submitted to us.
4.9. By submitting your work via our website you guarantee that, the document, which you are sending to us, does not contain any viruses and is within a format that we can access.
4.10. Although we take all necessary steps to ensure that all work that we send to you is free from virus that may harm the operation of your computer, we cannot guarantee that the work that we send to you will not include viruses. At present we use the latest virus protection software and would strongly advise you to do the same.
5. Completing and Returning Work
5.1. We aim to complete all work that you send to us within a minimum of 3 working days and a maximum of 30 working days after receiving it.
5.2. The time that we take to complete your work, will vary according to the amount of work that you are asking us to do.
5.3. We will send you a time scale with details of when we expect your work to be completed.
5.4. You may also track the progress of your work, using the relevant feature on our website.
5.5. Where we cannot complete your work within the stated time period, we will contact you in advance to inform you of the new time period for returning your work.
5.6. Where your work has not been completed within a minimum of 3 working days and a maximum of 30 working days of receiving it, you will be entitled to a full refund as detailed in s.12 of this agreement and we may also provide additional offers to you at our discretion.
5.7. We cannot accept liability for failing to return your work within the specified timescale owing to circumstances beyond our control, such as power outages, flooding and other natural disasters, disruption in internet connection and any other event that we cannot reasonably foresee and which is beyond our control.
5.8. When returning work to customers who have taken out a subscription package with us we may also include a Review Work Evaluation (RWE) Form which will clearly indicate the work that we have done and any other comments and or recommendations that we have made. Where we have not included a RWE Form, you may be able to request one.
5.9. If you do not have a subscription package with us, we can still send you a RWE Form, however this will incur an additional charge of £5.00
5.10. We will return your work via email unless you have made alterative arrangements for us to return your work to you using another method, such as post or fax.
5.11. You will be responsible for paying any additional charges that arise from returning your work by post or fax
6. Payment & Cost
6.1. You must ensure that you pay for your work before sending any works to us. Payment can be made by following the steps indicated on our website. You can pay us by cash, cheque or by using a credit/debit card
6.2. We will send you an invoice for all payments. Our invoice will include details of the payment method that you can use in order to make payment to us.
6.3. Online payments will be made using PayPal, we do not accept liability for errors that you enter when making your transaction with this Third Party Website. However, Pay Pal is regarded as one of the safest and most secure online payment method, therefore this will minimise the risk of any adverse activities occurring during your transaction.
6.4. If you are not the debit/credit card holder, you must ensure that you receive the express consent of the card owner before using the card as we will not accept any liability arising from improper and unauthorised usage of debit/credit card or our payment facilities.
6.5. Once you have paid for your work, you will be given a unique order number that you can then use to track the process of your orders
6.6. If you take out one of our subscription options, you agree that we will be able to debit your account for the total subscription fees for that period
6.7. If you fail to pay us for any work that we have done, we reserve the right to take appropriate enforcement action against you to secure the outstanding sum.
6.8. We will only take enforcement actions against you where:
i) You fail to make payment after 3 consecutive invoices and;
ii) You fail to make payment after 2 consecutive letters of reminder, which will be sent to you by email or post.
6.9. We may provide a discount for payments offered by standing order, where we intend to provide such a discount we will notify you in advance.
6.10. Payment will not currently include VAT however whenever this changes we will notify you of this.
6.11. We reserve the right to refuse to send your work to you, if we have not received your payment in full.
6.12. The cost of the work that we review for you under our subscription package will depend on the type of subscription service that you have with us. These are shown clearly in our information brochure and on our website
6.13. We reserve the right to increase our cost if we find that the work that you send us requires a greater level of time, expertise and correction than we envisaged.
6.14. Where the cost of your work is likely to increase we will notify you of this in advance, using our minimum notice period of at least 3 working days.
6.15. We can only accept payment by cash in areas where we have a customer service representative to collect payment.
6.16. You can make payment directly into our Barclays Bank Account. Please contact us if you intend to pay using this method and we will provide you with our account details.
6.17. All online payment must be made using credit or debit card; we offer a very simple and secure payment option. Should you experience any problems in making payment, please contact us.
6.18. Where we have arranged for you to pay by cash to one of our customer service representatives. It is your duty to check their identification; each of our representatives has an identification card and an employee number. If you are still in doubt about the identification of any of our representatives we would strongly advise that you should contact us directly to verify their identification.
6.19. We can only arrange for you to pay our customer service representatives in selected areas at present they are present.
6.20. All phone charges to our 0207 number will be based on local and national rates. If you are using a BT phone this will be 5p per minute. While all cost to our 0800 number will be free to customers in the UK.
6.21. International call charges will apply to customers calling from outside the UK.
6.22. If you are calling us using your mobile (cell) phone the call charges will be based on those set by your mobile phone provider.
6.23. We will not accept liability for paying any phone charges, excepting for those phone charges that arise from calls made to our 0800 number.
6.24. Calls made via Skype will be free subject to Skype’s terms and conditions.
6.25. Where we intend to charge for one of our service provided through Skype (e.g. our tuition service), we will notify you of this in advance and you will be sent an invoice to make payment once our session has ended.
6.26. You agree to make all payments owing to us on time, where you fail to make payment on time; we reserve the right to issue you with a late payment charge of between: £5-£20 depending on the value of the work that we have conducted for you.
7. Grievance and Complaints
7.1. Where you have a grievance or a complaint against us, this will be dealt with under our complaints procedure.
7.2. You are entitled to a copy of our full complaints procedure, which you can obtain by contacting us.
7.3. We will endeavour to address all complaints made against us within 14 days of the complaint being made; where this is likely to take longer we will provide you with written notice of this.
7.4. We will provide you with a complaint form, where you are required to clearly set out the grievance that you have, the date it occurred and against whom. You can then return this form to us by email at: customercare@review4students.com
7.5. If we uphold your complaint, we will provide you with an appropriate remedy for this that may include offers or discounts. We will also ensure that we make relevant operational changes in order to address the issue that you have complained about.
7.6. Complaints will be dealt with by our human resource team, where our human resource team has not been formed; complaints will be dealt with by the Managing Director, who may choose to appoint a competent and independent person or body to investigate and respond to your complaint. Otherwise, the Managing Director will address the issues that you have complained about.
7.7. We strive to resolve all complaints made against us in a professional and amicable manner and will only resort to the courts, where all attempts to resolve the complaint between us has failed.
7.8. We will provide you with written notice of the outcome of our investigation once it has been concluded. We will also provide you with appropriate remedies as laid out in s.5.5.of this agreement.
8. Minimum Term of the Contract
8.1. Where you have opted to subscribe to our basic, silver or gold subscription a minimum period of 3 months will apply to the contract
8.2. Where you decide to terminate the contract before the minimum period a cancellation charge will apply.
8.3. You must ensure that you pay in full in order to avoid enforcement actions being taken against you as laid out in paragraph 4.3. of this agreement
8.4. Where you cannot pay the full cost of the contract we may agree to accept instalment payment.
8.5. You must write to us setting out why you cannot pay in full and send us all relevant documentary evidence in support of your request to by instalments.
9. Termination of the Contract
9.1. You may terminate your contract with us at any time by giving us a maximum of 7 days written notice.
9.2. A minimum ‘cooling off’ period of 7 days applies to this agreement.
9.3. The minimum cooling off period allows you to terminate this agreement with us without being subjected to penalty charge as detailed in s.9.4. of this agreement.
9.4. Where you terminate your contract before end of the minimum period of the contract a penalty charge will apply as detailed in paragraph 6.2. of this agreement. These charges will not apply during the minimum cooling off period, detailed in s.9.2. and 9.3. of this agreement.
9.5. If you decide to terminate your contract before the minimum period has ended, you will be required to pay for the full period of the contract.
9.6. Where you choose to terminate your contract we will keep records of your files for a period of 12 months after which they will be destroyed in accordance with the requirements of Data Protection Act1998.
9.7. Terminating your subscription with us will not affect your rights to use our services on a Pay-As-You-Use (instant payment/’Buy Now’) basis.
10. Data Protection
10.1. All data that we collect from you will be used to help us to provide an effective service to you and to assist in processing your order.
10.2. We will not disclose your data to any third parties unless we are required to do so by law.
10.3. By accepting the terms of this agreement you are agreeing that we can store, access and use your data, whether printed, recorded, electronically on paper or manually to assist us to improve the standard of service that we provide to you.
10.4. We will use your data in accordance with the Data Protection Act 1998.
10.5. You are entitled to request all data that we may hold on you. Where such a request is made it must be done in writing. We will send you a response within a maximum of 28 days of receiving your request.
10.6. We may carry out specific checks to verify the data that you have provided to us. Where such checks are made, they are done for security purposes and not to prevent you from accessing our services.
10.7. Where we intend to use your data in a way that is not covered by this agreement, we will send a notification of this and allow you to choose whether or not you will allow us to use your data.
10.8. We will not use your data in a way that will affect your security or safety and as explained in s.10.2. of this agreement, we will not pass your data to any third party without your consent excepting for where the law requires us to do so.
11. Liability
11.1. We will not accept any liability arising from errors that you have made in accessing and using our services.
11.2. We will accept liability for any act that we may do that results in death or personal injuries, saving this all other liabilities will be limited.
11.3. We will not accept liabilities for your negligence that occurs because you have failed to provide us with accurate information.
11.4. Where you have used our essay service we will not accept liability for any actions that may arise because you have submitted our essays as your own. As we have made clear on our website, our essay writing service is provided only to use as a guide on how to respond to a particular essay question
11.5. As specified in s.4.7 of this agreement, we will not accept liability occurring as a result of events which are beyond our control or that we cannot reasonably foresee.
11.6. We will accept liabilities resulting from our error in processing your information or in completing your work to the standard that we have specified
11.7. When using our website, we will not accept liability for any harm that you may suffer while using third party sites that may be linked to our website, such as Pay Pal; where your transactions with Pay Pal or any other third party sites linked to our website results in some sort of harm or loss to you, these will be subjected to the terms and conditions and dispute resolution policy of the third part website in question.
11.8. Where we have accepted liability for any aspect of our action that has result in loss or harm to you; any compensation or other remedies that we decide to give you will be limited to the amount of the loss suffered. This does not apply where the courts have ordered us to pay compensation to you.
12. Refunds & Discounts
12.1. We will provide refund to you where we are unable to provide a specific service that you have ordered.
12.2. You must ensure that you claim your refund within a minimum period of 60 working days.
12.3. In addition to providing you with a full refund we may provide you with a discount on some aspect of our service.
12.4. In order to claim your refund you will have to complete our refund form, clearly indicating why you are seeking a refund.
12.5. Whereas we will inform you of your entitlement to any specific discounts or special offer that is available to you.
12.6. The refunds, discounts and special offer that we provide will be at our discretion and is not a guarantee.
12.7. Refunds may be granted where the work that we have conducted is significantly different from the work that you have ordered.
12.8. We may also provide refunds for overpayments that we may receive as a result of an error or mistake in the processing of your transaction.
12.9. Our refund will not exceed the value of the service that you have ordered or the payment that you have made to us.
12.10. Once you have completed our Refund Form, we will consider your request and provide a response within 24 hours from receiving your completed Refund Form.
12.11. Where we refuse to pay a refund, you can apply for a reconsideration of our decision by sending further information or writing an appeal to us. This should be sent to: customercare@review4students.com
13. Dispute Resolution
13.1. In the event of any disputes between us, in the first instance please inform our customer care department of the dispute and also complete a complaint form, which we will send to you once you express your intention to make a complaint.
13.2. We will then attempt to resolve the dispute using our complaints procedure as detailed in s.6 of this agreement.
13.3. Where you are still dissatisfied with the outcome of our investigations and remedies that we have taken to resolve the dispute between us, we will resort to independent mediation.
13.4. We will not pursue litigation via the courts unless all the above areas has been exhausted and as a last resort, where all other attempts to resolve the dispute between us has failed.
13.5. This does not affect your statutory rights including your right to seek independent legal advice and/or appropriate representation.
13.6. Where we initiate our complaints procedure as detailed in s.6 of this agreement we may require you to attend an informal hearing or to supply us with additional information that will help to assist us in resolving the dispute between us.
14. Governing Law
14.1. Any disputes resulting in litigation between us, will be governed by the jurisdiction of England and Wales and the Laws of England & Wales will apply.
14.2. We will not resort to litigation without first trying to resolve the dispute between us as detailed in s.13 of this agreement.
